Endo Market ("Endo," "we") is operated by Endo Powersports LLC, a California company. By checking the agreement box when you create an account, by signing in, or by otherwise using the service (including browsing as a guest), you agree to these Terms and to our Dispute Policy and Prohibited Items Policy, which are incorporated by reference, and you acknowledge our Privacy Policy. We keep a record of the date and the version of the Terms you accepted. If you do not agree, do not use the service. These Terms are also the end user license agreement (EULA) for the Endo Market apps on iOS and Android: we grant you a personal, non-transferable, revocable license to use the app on devices you own, and the app store you got it from is not a party to these Terms.
You must be at least 18 years old, able to form a binding contract, and located in the United States or Canada (excluding Quebec). When you create an account you confirm that each of these is true, and we rely on that confirmation. An account opened by someone under 18, or on false information, may be closed without notice. Accounts require a verified email and phone number. One account per person. By providing your phone number you consent to receive transactional text messages (verification codes and security alerts); we do not send marketing texts, and message and data rates may apply.
Endo is a marketplace venue. Sales are contracts between the buyer and the seller, Endo is not the seller, does not take title to items, and does not guarantee any item's condition, authenticity, legality, or fitness. Endo does provide payment processing and escrow: buyer payments are held and released to the seller per Section 7. Payment processing services are provided by our payment processor and are additionally subject to its terms.
Deals are between users. Every sale, purchase, offer, trade, and local meetup arranged through Endo is a transaction solely between the buyer and the seller. Endo is not a party to it, is not the agent of either user, and does not inspect, test, appraise, or verify items, listings, or the people behind them, even where an account shows a Verified badge. You alone decide who to deal with and on what terms, and you do so at your own risk. To the maximum extent permitted by law, Endo is not responsible or liable for any loss, damage, injury, or dispute arising out of a transaction or interaction between users. That includes an item that is misdescribed, defective, counterfeit, stolen, unsafe, damaged, lost, or never delivered; a buyer or seller who does not perform; a payment made or requested outside of Endo checkout; a failed or one-sided trade, except for the collateral process of a protected trade described in Section 10; and the conduct of any user, online or in person. For an eligible order paid through Endo checkout, the process in the Dispute Policy is the only remedy Endo provides, and for a protected trade, the process in Section 10 is.
Release. If you have a dispute with another user, you release Endo Powersports LLC and its owners, officers, employees, and agents from all claims, demands, and damages of every kind, known or unknown, arising out of or in any way connected with that dispute or the underlying transaction. You waive California Civil Code Section 1542, and any similar law, which says: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party." This release does not cover Endo's own obligations under the Dispute Policy or, for a protected trade, under Section 10, or any liability that cannot be released under applicable law.
Keep your credentials secure; you are responsible for activity on your account. We strongly recommend enabling two-factor authentication. Notify us immediately of unauthorized use. We may suspend accounts to protect users or the platform.
Sellers must own the items they list, describe them accurately (including damage and modifications), price and photograph the actual item, and honor completed sales. Listing stolen goods, goods with altered or removed serial numbers/VINs, or items on the Prohibited Items Policy is grounds for immediate termination and referral to law enforcement. We cooperate with law-enforcement requests regarding stolen property.
Buyers pay the item price, shipping (on shipped orders, which includes postage at the carrier's rate for your address plus a $1.50 handling charge Endo keeps), an Endo service fee of 6% of the item price plus $1 per order, and applicable sales tax at checkout. On a free-shipping listing the seller covers the postage and the handling charge instead, out of the seller's payout. Sellers pay 0% seller fees and keep 100% of the item price, minus the label and the handling charge when they choose free shipping, and minus any optional instant payout fee. Current rates are published in Fees & Payouts. Any sales tax Endo collects will be shown at checkout before payment. Tax obligations follow applicable law. Circumventing Endo service fees by completing on-platform-initiated deals off-platform is prohibited and forfeits all buyer and seller protections.
Buyer funds are held by Endo (via our payment processor) and released to the seller when: (a) the buyer confirms delivery; (b) for local pickup, the seller enters the buyer's pickup code at handoff; or (c) the dispute window lapses after confirmed delivery with no dispute opened. Opening a dispute pauses release until resolution under the Dispute Policy.
Shipping labels are generated through the platform at the buyer's expense unless the listing states otherwise. Sellers must get the item to a carrier for its first scan within 72 hours of payment, using the provided label, pack items adequately, and retain proof of shipment. If no carrier scan is recorded within that window, the order is cancelled automatically, the buyer is refunded in full, and the shipping label is voided. A seller who reports a drop-off with a photo before the deadline gets one 48 hour extension while the carrier catches up. Risk of loss in transit is handled through the Dispute Policy. Lithium batteries must be shipped in compliance with applicable DOT/carrier regulations, sellers are responsible for compliance.
Late arrival after a refund. If an item arrives after an automatic refund under this section, the buyer must either pay for it through Endo or send it back with the prepaid label Endo provides. Keeping the item without paying is a breach of these Terms.
Who can buy. Riders located in Canada, outside Quebec, may open an account and buy parts and gear from sellers in the United States. Selling on Endo Market is open to sellers located in the United States only. Endo Market is not offered in Quebec at this time.
Cross-border shipping. A seller chooses whether a listing ships to Canada and sets that shipping price in US dollars. All prices on Endo Market are in US dollars; your card issuer or bank sets the exchange rate and may add its own fees. Local pickup is not available across the border.
Duties and import taxes. You are the importer of record. Customs duties, GST/HST and any brokerage fees charged by the carrier are your responsibility and are collected on delivery, not at checkout. Refusing a delivery over these charges is not a defect in the item; return shipping and any charges the carrier bills back are deducted from any refund.
Restricted items. Whole bikes, lithium batteries and items containing them cannot be shipped internationally through Endo Market and are sold within the United States only. Items must also be lawful to import into Canada; you are responsible for checking that.
Your local law. Nothing in these Terms limits rights you have under the consumer protection law of your province or territory that cannot be waived by contract. Section 19 applies to the extent your local law allows.
Transaction problems are resolved under our Dispute Policy, which you agree to use before initiating a payment-network chargeback. Refunds for damaged, not-as-described, or wrong items are return-first: a return label is issued and the refund is processed after return. Abuse of the dispute system is grounds for account action. Protected trades are resolved under Section 10 instead, and you agree to use that process before initiating a chargeback on a trade charge.
Offers. Offers, cash or trade, expire 7 days after they are sent or countered. Sending a cash offer places no hold on your payment method and charges nothing. If the seller accepts your offer, or you accept a seller's counter, the item is reserved for you for 48 hours and you pay for it at checkout, at the accepted amount plus shipping if any and the buyer service fee, with any payment method checkout offers. If it is not paid within those 48 hours, the acceptance is undone and the item returns to sale. You may withdraw an offer until it is accepted, and back out of an accepted offer until you pay. An accepted offer becomes an order like any other, under the same shipping rules, escrow, and buyer protection as a purchase at the listed price.
Trades. A trade is a swap of one user's item for another user's item, with cash on top if the two of you agree to it. There are two kinds. A protected trade is backed by collateral from both users, as described below, and is the kind the app sets up when protected trades are available. A trade offer is the older kind, with no collateral. The app tells you which kind you are in before you commit to anything. In both kinds the swap is between the two users: Endo holds the money and runs the process below, but it is not a party to the swap and does not inspect, value, or guarantee either item, and Section 3 applies.
Protected trades: what you pay. After a protected trade is accepted, each user has 24 hours to authorize a card payment for their side. Protected trades are card only, and your bank may ask you to confirm the payment. Your side is: (a) collateral equal to the agreed value of the item you will receive, meaning its listing price or the value written into the proposal; (b) any cash you agreed to add; and (c) Endo's fees, which are a $2.50 trade fee, an escrow fee of 3% of your collateral, and the buyer service fee on any cash you add. The app shows each of these amounts before you authorize. Authorizing places a hold on your card and charges nothing. When both users have authorized, both cards are charged at the same time, Endo holds the collateral and cash through its payment processor, and the trade goes live. If the other user does not authorize within the 24 hours, your hold is released and nothing is charged. If you cancel after authorizing and before the trade goes live, your fees are charged and the rest of your hold is released.
Protected trades: shipping and evidence. Each user ships only on a shipping label bought through Endo, in one box; a tracking number from anywhere else does not count. Before the label is bought, you add at least 2 photos of your item with the trade code the app gives you, and the packed box's dimensions and weight. Endo buys the label, insures it at the item's value, requires a signature on delivery for items worth more than $750, and takes the label's cost out of your collateral refund. A label may not cost more than your collateral. You must get a carrier acceptance scan on your Endo label within 3 days after both cards are charged; once the other user's box has its first carrier scan, you have at least 3 days from that scan. Printing a label is not shipping: only the carrier's scan counts. We compare the weight the carrier records with the weight you declared, and a large difference sends the trade to review.
Protected trades: what you get back, and when. Your collateral is refunded to the card you paid with, minus the cost of your label, 48 hours after the carrier records delivery of the item you shipped, unless the other user opens a dispute in that window. If you are owed cash, it is paid to your payout account at the same point. Endo's fees are not refunded once both cards are charged, except when a trade fails because of an error on our side. If both users cancel before either box has a carrier scan, or neither box gets a carrier scan by its deadline, the trade is cancelled and all collateral and cash is refunded, but the fees are kept; a label that was bought and never scanned is refunded through the carrier and not taken out of your refund.
Protected trades: not shipping. If the other user's box has a carrier scan and yours does not by your deadline, or you cancel after their box has been scanned, you have defaulted. Your collateral and any cash you added are then paid to the other user, any cash they added is refunded to them, and their collateral is refunded as usual once the item they shipped clears. You agree that this amount is a reasonable estimate of the loss a failed trade causes the other user, which is hard to measure in advance, and that it is liquidated damages and not a penalty. A box that gets its first scan after a default does not undo the default automatically; Endo reviews it.
Protected trades: disputes. Only the user who received a box can dispute it, within 48 hours after the carrier records delivery, with at least 2 photos or a video, for one of these reasons: not received, empty box, wrong item, not as described, or damaged. A not-received claim can be opened once the box is late: 3 days after the carrier's expected delivery date, or 10 days after its first carrier scan if the carrier gave no date, or right away if the carrier reports a delivery failure. When a dispute is opened, when the carrier returns or loses a box, or when we see signs of fraud, the trade is frozen: both users' collateral, and any cash still held, stay with Endo, and nothing is refunded or paid out until an Endo admin has reviewed both users' evidence and the carrier's record and decided. The user who shipped the disputed box has 7 days to respond. Nothing is decided automatically, and frozen money is not released on a timer. When an item is claimed to be the wrong item, not as described, or damaged, it must first be returned on an Endo label, and its original shipper gets 48 hours after the return is delivered to contest what came back, before any collateral is paid to the user who claimed. Loss or damage caused by the carrier is handled through the label's insurance and does not forfeit anyone's collateral. The admin may refund both users, decide for either user, or split the money held. Collateral already refunded after its 48 hours ended is not taken back by a later dispute.
Protected trades: limits and chargebacks. To trade you need a verified account and a payout account set up in Wallet. Endo may set minimum and maximum item values, limit how much a newer account can have riding on open trades, pause trading for a user who repeatedly cancels or does not fund, and decline a trade or hold it for review, for example when two accounts appear to belong to the same person. If you file a chargeback on a trade charge, that trade, your other open trades, and your payouts are frozen until the chargeback is resolved. The timeframes in this section are the ones in effect today; the app shows the exact deadlines for your trade, and those are the ones that apply.
Trade offers. Trade offers are as-is exchanges between users with no collateral; inspect before you swap. Either user can add cash to a trade offer: the user making the offer can add it, or ask the other user to add it, and either user can counter with different cash in either direction. Nothing is charged when a trade offer is sent or accepted. The user who owes the cash pays it in the app within 48 hours of the acceptance, with any payment method checkout offers, at the agreed amount plus the service fee. If it is not paid in that time, the trade is called off and both items return to sale. The cash is held by Endo, released to the other user when both confirm the swap, and refunded to the user who paid it if the swap is not confirmed within 7 days. Do not hand an item over until the cash shows as paid. Apart from that cash, Endo does not step in if the other user does not hand over their item.
Endo Book. Endo Book values are informational estimates from market data, not appraisals, offers, or guarantees.
Self-serve advertisers are responsible for their creatives and landing pages, which must be lawful, accurate, and appropriate. We may reject, pause, or remove any creative, including creatives disabled by user reports. Charges accrue against actual delivery up to your daily cap; spend already delivered is not refundable when a creative is removed for policy violations. Repeated violations forfeit advertising privileges.
No fraud or misrepresentation; no fee circumvention; no harassment or hate; no false reports or dispute abuse; no manipulation of ratings or verification; no scraping, reverse engineering, or interference with the service; no use of the service to violate any law.
Zero tolerance for objectionable content and abusive users. Listings, photos, messages, reviews and names are screened by automated moderation before they are stored, and anything sexual, violent, hateful, harassing, illegal, or unrelated to riding is refused. You can report any listing or rider from the app and block anyone; we review reports within 24 hours, remove the content, and suspend or ban the account responsible. Posting objectionable content is grounds for immediate termination.
Electric motorbikes sold here are generally intended for closed-course/off-road use. You are solely responsible for knowing and complying with the laws where you ride, including registration, licensing, equipment, and land-use rules. Used vehicles and parts are sold by their owners as-is unless the seller states otherwise; inspect before purchase or promptly on delivery. High-voltage batteries can be dangerous, handle, charge, and store them properly. Always wear protective gear. Endo makes no warranty of roadworthiness, safety, or legality of any item.
You retain ownership of content you post (photos, listings, messages, reviews) and grant Endo a non-exclusive, worldwide, royalty-free license to host, display, and use it to operate and promote the service. Don't post content you don't have rights to, including photos lifted from another seller's listing or a brand's website.

Repeat infringers. We terminate, in appropriate circumstances, the accounts of riders who repeatedly infringe. Sending a notice or counter-notice you know is false can make you liable for damages under 17 U.S.C. 512(f).
You may close your account at any time; obligations from completed or pending transactions survive. We may suspend or terminate accounts that violate these Terms, create risk for users, or as required by law. Sections 3, 9, and 14-20 survive termination.
